Malta Rental Contracts and Housing Authority Registration

Understand what a Malta residential lease should record, why registration matters, and how renewals, notices and occupants are documented.

A residential lease should state the commercial deal clearly and be registered through the Housing Authority where the law requires it. Registration is not a substitute for reading the contract.

Check the parties, property, term, rent, deposit, inventory, occupants, payment method, utilities, notice and renewal wording before signing. Compare the draft with the Housing Authority's rental contract rules, then obtain proof of registration after the lease is signed.

Names, address, term, rent and occupants should not conflict across documents.

Notice rules are time-sensitive

The applicable law and contract govern termination or renewal steps; calendar them immediately.

For ordinary long private residential leases, the statutory tenant release/notice pattern is:

The landlord must give at least three months' written notice before expiry if the lease will not be renewed; without it, the lease can renew automatically for another year. Contract clauses can give a tenant more favourable rights but should not remove statutory minimum protection.

Example: in a one-year lease starting 1 January, the tenant is bound through the first six months and can then terminate using one month's notice under the statutory route. A tenant wishing simply to leave at the fixed expiry should still follow the contract's written notice procedure and obtain termination confirmation. Do not confuse tenant early release with the landlord's three-month non-renewal notice.

Inventory belongs with the agreement

Attach a detailed move-in record rather than relying on a generic furnished statement.

From draft contract to registration confirmation

  1. Ask for the complete draft and verify the parties and property address.
  2. Check duration, rent, payment method, deposit, occupants, renewal and notice wording.
  3. Make sure utility, maintenance, access, pets and subletting terms match what was agreed.
  4. Attach and sign the inventory, condition photographs and meter readings. Download the current lease, inventory and lessor declaration forms.
  5. Confirm the landlord has the mandatory lessor self-declaration needed for registration.
  6. Sign only when blank spaces and conflicting side agreements are resolved.
  7. Pay by a traceable method and retain the signed copies.
  8. The landlord uses the Housing Authority's registration service to upload the signed lease, inventory and lessor self-declaration. Current guidance says registration must happen within 30 days from commencement.
  9. Obtain and check the registration confirmation; calendar renewal or notice dates.

  • What is the exact start date and term?
  • What can be deducted from the deposit?
  • Who pays each utility and common charge?
  • Who may enter the property and with what notice?
  • How is renewal or termination handled?
  • What evidence will I receive when the lease is registered?

Who does what

The tenant reads, negotiates, signs and keeps evidence. The landlord is responsible for registering the signed private residential lease. Current Housing Authority guidance gives the landlord 30 days from commencement. A notary is not a routine requirement for an ordinary rental contract, but legal advice remains available when the arrangement is unusual.
