Remote Working from Malta and the Nomad Residence Permit

Work out whether you can live in Malta while working abroad, including immigration, the Nomad Residence Permit, payroll and tax-residence checks.

You may live in Malta while working remotely for a foreign employer or clients only when immigration, employer compliance, social security and tax all work together. A laptop job does not make residence automatic, and a residence permit does not settle tax.

Nomad Residence Permit essentials

The applicant must be a TCN and work remotely using telecommunications for:

  • A foreign employer under a valid contract;
  • A foreign company they own or partly own; or
  • Foreign clients under service contracts.

The current threshold is €42,000 gross annual income. Prepare a valid passport, contracts and income evidence, CV/declarations, health insurance covering Malta, background documents and evidence of accommodation. The application fee is currently €300 per person. Approval is discretionary and due diligence applies.

The permit is normally issued for one year and can be renewed up to three times, giving a maximum stay of four years if the renewal conditions continue to be met. It does not lead automatically to permanent residence and does not authorise local employment.

Use the official Nomad application portal and checklist. Do not pay an intermediary who promises guaranteed approval.

The four compliance questions to answer

1. May the employer legally have you work from Malta?

Ask the employer to assess Maltese payroll withholding, employment law, corporate permanent-establishment risk, data protection and insurance. A letter saying “remote work allowed” is not the same as a cross-border compliance review.

2. Where is social security due?

Within EU/EEA coordination, an A1 certificate may keep a temporarily posted or multi-state worker in another country's system if the legal conditions are met. Otherwise Malta contributions may apply. A private insurance policy does not replace statutory social security.

3. Will you become Malta tax resident?

Day count matters but is not the only test. Malta can treat a person as resident from arrival when they come to establish residence, and residence can also arise through ordinary residence. A treaty tie-breaker may be needed if two countries claim residence.

Nomad Permit holders have a specific tax framework with conditions and timing. Do not assume “foreign employer” means tax-free. Obtain advice covering salary, freelance profit, investment income and any overseas company you manage from Malta.

4. Is the relationship really employment or self-employment?

Control, risk and working arrangements matter more than the contract label. Misclassification can change payroll, leave, VAT and contributions.

Before moving: written checklist

  • Residence route and permission to work remotely
  • Employer approval naming Malta as the work location
  • Tax-residence analysis for both countries and treaty position
  • Payroll/withholding decision and social-security certificate or registration
  • Health cover valid from arrival until public entitlement is confirmed
  • Malta accommodation that satisfies the residence route
  • Cross-border VAT assessment for freelancers
  • Plan if the job/client ends before the permit expires
